In most cases it's obvious when someone is homeless, but some people may be 'legally homeless' even though they still have somewhere to live. The council has a duty to help certain people who are homeless or threatened with homelessness.
You are legally homeless if:
- You have no accommodation available to you anywhere either in the UK or abroad
- You have a home but need to leave it because of violence or threats of violence
- Your family is forced to live in separate homes when they would normally live together under one roof
- You live in a caravan, mobile home or boat but have nowhere to park it
- You have accommodation but it is not reasonable for you to continue to occupy it eg it's in poor repair
- You have accommodation but you can't continue to occupy it eg you're about to be evicted, you've been locked out, you can't afford it etc
You are threatened with homelessness if:
- You can show that you will be homeless within 28 days
